Agent & Agency Terms

Extra obligations that apply if you advertise on behalf of clients. They sit on top of the Terms of Service, not instead of them.

1. Who these apply to

These terms apply to any account registered as an agent or agency — anyone advertising property they do not personally own. Individual owners listing their own home are covered by the Terms of Service and Listing Rules alone.

2. Your agency profile

Signing up as an agent creates an agency profile you control from Dashboard →  Settings → Agency. You are responsible for keeping it accurate: the trading name, office address, contact number, and registration number where you have one.

  • The trading name must be the name you actually operate under. Do not register a name resembling another agency's.
  • The contact number and email must reach someone who can answer enquiries during business hours.
  • The logo must be your agency's own mark, or one you are licensed to use.

3. Verification

A verified badge means an Openlet staff member has checked your agency's registration details against the documents you supplied. It is a check on your identity as a business — not an endorsement, a licence, or any warranty about the quality of your service or the accuracy of your listings.

  • Verification is requested by emailing [email protected] once your profile is complete.
  • Changing your agency name or registration number resets the badge, and it must be earned again. Cosmetic edits — logo, description, opening hours — do not.
  • We may withdraw the badge at any time, including where listings are repeatedly removed or enquiries go unanswered.
  • Claiming to be verified when you are not, in a listing or elsewhere, closes the account.

4. Authority to advertise

For every property you list you must hold a current instruction from the owner, or from someone entitled to act for the owner, permitting you to advertise it on the terms shown. You must be able to produce evidence of that instruction on request, and you must remove the listing as soon as the instruction ends.

Listing a property speculatively — to test the market, to attract enquiries you intend to redirect, or before you have the owner's agreement — is a breach of these terms and may also be an offence.

5. Dealing with buyers and tenants

  • Disclose that you are acting as an agent, and for whom, at first contact.
  • Disclose any personal interest you or a connected person has in a property.
  • Quote fees, commissions and charges clearly and in LKR before anyone commits to anything.
  • Do not use enquiry contact details for anything other than answering that enquiry. Adding an enquirer to a marketing list without their consent breaches the Privacy Policy and the PDPA.
  • Respond to enquiries within a reasonable time. Persistent non-response is a common reason listings are removed.

6. Client money

Openlet never holds, transfers, or escrows money between users. Any deposit, advance, reservation fee or rent you take from a buyer or tenant is taken by you, in your own capacity, and must be handled in accordance with Sri Lankan law and any professional obligations that apply to you. Do not represent to anyone that Openlet holds funds, guarantees a transaction, or provides any form of protection over a payment.

7. Multiple agents and staff accounts

Agents in the same agency share one agency profile. Each person must have their own account with their own password — shared logins make it impossible to tell who published what, and are a breach of the Terms of Service. To add or remove staff from an agency profile, email [email protected] from the agency's registered contact address.

8. Data protection

When you receive an enquirer's details you become responsible for that personal data in your own right, and the Personal Data Protection Act No. 9 of 2022 applies to you directly. Use the data only to respond to the enquiry, keep it no longer than you need it, and honour any request from the enquirer to delete it.

9. Breach

Breaching these terms may result in listings being removed, the verified badge being withdrawn, the agency profile being suspended, or the account and all its listings being closed. Where a breach involves advertising without authority or misrepresenting a property, we may also inform the owner and the relevant authorities.
